Ditch trip leads to second OWI for Minnesota man

BALSAM LAKE – A man who slid into a ditch at about 2 a.m. on Saturday, Feb. 23, near Luck is now facing his second charge of operating while intoxicated.
According to the probable cause report filed by the Polk County Sheriff’s Office, the incident took place on 240th Street, just north of Hwy. 35, when a PCSO deputy came upon the vehicle that had slid into a ditch.
The driver told police he swerved to miss a deer and slid into the ditch, but he was noticeably unsteady on his feet and swaying, as well as slurring his words, later admitting to having “a few beers” prior to the incident.
The driver was identified as Shawn A. Smith, 41, Shafer, Minnesota, who has a previous OWI conviction on his record.
Smith failed a field sobriety test and registered a blood alcohol concentration of .23 percent, almost three times the legal limit to drive. He was charged with OWI, second, and taken into custody, with an initial court appearance slated for Monday, March 25, before Judge Jeffery Anderson.
